Food Additive Regulations: FDA and EFSA Requirements for Food Manufacturers
Two Regulatory Philosophies, One Direction: Stricter
In US, FDA is responsible for approving food additives, while in EU, EFSA conducts safety assessments and provides recommendations to European Commission. But 2026 brings both agencies closer to pre-market proof model.
Food Additives Manufacturer Trusted Supplier Guide table: FDA GRAS/FAP vs EFSA Approval – Ingredients either Generally Recognized as Safe or approved via Food Additive Petition. EFSA approved additives assigned E-number and listed in Regulation (EC) No 1333/2008.
Most significant difference is GRAS system. In US, food manufacturer can determine ingredient is GRAS without FDA review. Estimated 1,000+ food additives have entered American food supply through GRAS self-certification with no independent FDA safety assessment. EU has no equivalent – every single food additive requires EFSA pre-approval.
That gap closes in 2026.
US FDA Requirements in 2026
End of Self-GRAS Pathway
On August 10, 2026, U.S. Department of Health and Human Services issued request for comments proposing to eliminate voluntary self-determined Generally Recognized as Safe (Self-GRAS) pathway. Under proposal, when manufacturer determines substance added to food is GRAS, it would generally be required to submit GRAS notice to FDA. Comment period remains open through December 9, 2026.
What FDA has proposed: On August 11, 2026, FDA published proposed rule that would introduce mandatory GRAS notification. Under current system, company can conclude on its own that ingredient is GRAS for intended use and put it on market with self-GRAS without telling agency. If GRAS notification requirement not met, FDA intends to consider noncompliance as violation. On August 10, HHS announced FDA's widely anticipated proposed rule requiring submission of GRAS notifications. FDA proposes to amend 21 CFR parts 170 and 570.
Proposed rule scheduled for December 2026 Federal Register publication as Docket FDA-2025-N-3262 (RIN 0910-AJ02). Until final, FDA GRAS Inventory Rule represents pivotal shift toward visibility and accountability. Success will depend not just on innovation speed but strength, clarity, defensibility of safety data.
Color Additive Overhaul: MAHA Initiative
From 2025 to 2026, FDA, in alignment with Make America Healthy Again (MAHA) initiative, has introduced series of intensive measures to drive transition of US food supply from petroleum-based synthetic dyes to naturally derived alternatives. By revoking authorizations for harmful synthetic colors, accelerating approval of natural alternatives, tightening purity oversight, and easing restrictions on No Artificial Colors labeling claims, FDA is facilitating natural upgrade.
Key actions in 2026:
FDA Proposes to Revoke Authorization for Citrus Red No. 2 and Finalizes Revocation of Orange B – both scheduled for Federal Register July 23 2026 – based on determination that authorized uses have effectively been abandoned by industry
Both agencies concluded available scientific data do not support alleged health risks associated with ingesting Red No. 3, which maintains status as approved color. Although FDA scientists determined Red No. 3 does not pose risk, ban nonetheless under Delaney Clause requiring FDA to prohibit use of any additive shown to induce cancer in humans or animals
U.S. FDA Accepts Three Food Color Additive Petitions – On August 19, 2026, FDA published notices announcing filing of three color additive petitions concerning gardenia (genipin) blue, safflower extract, and carrot oil – seeking to amend existing color additive regulations, remain subject to review
Food manufacturers must reformulate if using Citrus Red No.2 (used for Florida oranges), Orange B (sausage casings), and prepare for Red No.3 phase-out by 2027-2028 deadline.

New Authorizations and Flexibilities
US FDA Amends Food Additive Regulations to Authorize Inactive Bakers Yeast as Source of Vitamin D2 – On 25 September 2026, FDA published final order amending 21 CFR part 172 by adding §172.383 Vitamin D2 Inactive Bakers Yeast – authorizes in specified food categories – became effective upon publication.
U.S. Requirements and Regulatory Trends for Caffeine in Foods – growing concern over excessive intake and acute toxicity attracting regulatory attention – expect caffeine limits in functional snacks and beverages.
U.S. FDA Issues Final Rule Permitting Salt Substitutes in Standardized Foods – On 9 October 2026, FDA announced final rule permitting use of salt substitutes in foods whose standards of identity specify sodium chloride as required or optional ingredient – provides flexibility to reduce sodium – published Federal Register Oct 13 2026, takes effect Dec 14 2026. Potassium chloride can now replace salt in bread, cheese, ketchup without deviating from standard of identity.
On 29 September 2026, FDA published notice requesting comments on information collection requirements related to food additive and color additive petitions, including labeling requirements – identified as Federal Register document 2026-19850 – cited as 91 FR 61408.
Post-Market Reassessment
Regulatory pressure will intensify as FDA initiated post-market safety reassessments for preservatives like BHA and plans to review BHT in 2026, forcing manufacturers to adopt more frequent testing cycles – FDA Human Foods Program 2026 Priority Deliverables, February 2026. Manufacturers using BHA/BHT must prepare alternatives and safety data.
EU EFSA Requirements in 2026
New Scientific Data Guidance Effective July 20, 2026
EFSA's New Guidance for Food Additive Applications Takes Effect in July, Raising Bar for EU Market Access – On January 20, 2026, European Food Safety Authority published new Guidance on scientific data requirements for application for authorization of food additive submitted under Regulation (EC) No 1331/2008. Guidance applies to applications for both authorization of new food additives and modifications to conditions of use of already authorized additives. New data requirements became applicable to applications submitted from July 20, 2026. Guidance replaces previous 2012 scientific guidance and introduces more detailed and updated requirements for scientific information to be submitted by applicants.
What changes:
Toxicological data: enhanced genotoxicity battery, extended one-generation reproductive toxicity, microbiome impact assessment for certain additives (emulsifiers, sweeteners)
Exposure assessment: use of more refined EFSA Comprehensive Food Consumption Database, including vulnerable groups
Manufacturing and specifications: detailed characterization of particle size distribution for nanomaterial-containing additives, impurity profiles, and stability under intended uses
Alternative methods: promotion of New Approach Methodologies (NAMs) – in vitro, in silico – to reduce animal testing, but still requiring confirmatory studies for high-exposure additives
EU Common Authorization Procedure
EFSA conducts safety assessment, European Commission risk management, approval via Regulation (EC) No 1333/2008 positive list with E-numbers. Unlike FDA GRAS/FAP dual path, EU has single centralized path.
Food Packaging Standards 2026 For Manufacturers note: While FDA relies heavily on positive lists of acceptable substances, EU framework places immense emphasis on overall limit of what can migrate from packaging to food, regardless of substance's specific identity. Primary Focus: FDA – Indirect Food Additives CFR 21, EFSA – Overall Migration Limit (OML) & Specific Migration Limit (SML).
Contaminant Limits Tightened
EU Amends Maximum Levels for 3-MCPD, 3-MCPD Fatty Acid Esters and Glycidyl Fatty Acid Esters in Food – On 29 July 2026, Commission adopted Regulation (EU) 2026/1825, amending Regulation (EU) 2023/915 with regard to maximum levels – entered into force Aug 19 2026 – binding in all Member States. Impacts refined oils, infant formula, bakery.
EU Sets Maximum Levels for Δ9-THC Equivalents in Hemp Leaves and Hemp Leaf Infusions – Published July 29 2026, applies from Jan 1 2027 – affects botanical additives and CBD-adjacent products.
